29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: a) Colorado Excavating at the alley behind 1615 Osceola St in Denver, CO 80204: On or before July 2, 2018, the exposing employer did not ensure that employees working inside a trench with near vertical walls were protected from cave-in, in that employees were working in the trench to connect sewer lines between a house and the main line. The trench was approximately 16 feet in depth, 5 feet in width, and 7 feet in length and the trench box used as 12 feet tall, and 4 feet wide; the box was seated in the bottom of the trench exposing 4 feet of soil above the trench box. On June 22, 2018, the top four feet of soil sluffed off and fell into the trench causing an employee to be struck by the soil; the employee was knocked to their knees and buried to their waist. This condition exposed employees to a crushing and struck-by hazards by excavation wall cave-in. Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. |
