Citation text line OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees at the production shop Computerized Numerical Control (CNC) machine centers where safety devices such as mode switches and interlocks were improperly controlled, missing and/or defeated: a) Production shop: On or about March 1, 2022, and at times prior, CNC machine centers, including those manufactured by HAAS, Fadel and Toyoda, were operated with no key control procedures to prevent operators from switching between production and maintenance modes. Keys remained in machines during production which allowed operators to bypass interlocked access points while the machining center was energized and susceptible to unexpected, rapid movement. Additionally, all HAAS machine center programming and maintenance mode keys were interchangeable between modes and machines, meaning the presence of even one key allowed for switching between maintenance and operator modes on all HAAS machines. Examples include, but are not limited to, the following instances: - HAAS VF 5ss: maintenance mode key in the unlocked position and key present after turning key to the locked position. - HAAS VM 3c: in production with key present and available for operator to change modes to allow access to the point of operation. - HAAS VM 3 (1): the programming lock key was present and determined to be interchangeable with the maintenance mode key. - HAAS VM 3 (2): Keys were not present in the machine and both were in the locked position, however interchangeable keys defeat the device safety feature. b) Production shop: On or about March 1, 2022, and at times prior, CNC machine center interlocks were ineffective due to missing parts with efforts taken to defeat the interlock function designed to prevent employee access while hazardous machine movement was occurring at the point of operation. Examples include: - Toyoda 450S: The machining center was operated with an interlock device missing from the top of the right, front access door. - Fadel VMC 4020: The interlock switch was missing from the left side front access door. The door had been used in this condition using a length of covered wire to secure the door closed. - Amada Marvel PS2828/5 band saw platform entry gate interlock defeated by removing the gate key position sensor from the gate and inserting it into the interlock receiver on the guard railing.
