Citation text line 29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest system (PFAS). (a) ACC Roofing Inc., Denver Convention Center, 700 14th Street, Denver, CO: On or about September 21, 2012, the employer had not ensured all employees were provided with and using appropriate fall protection prior to the start of work. Employees were observed tearing off damaged roofing material on the Denver Convention Center Roof without fall protection. Condition exposed employees to a fall hazard in excess of 130 feet. (b) The employer had not ensured employees were provided with and using appropriate fall protection prior to staging rolls of roofing material along the south side of the flat roof section below the roof blade. Condition exposed employees to a fall hazard of approximately 15 feet. ACC Roofing was previously cited for a violation of this Occupational Safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 311905392, citation number 1, item number 1, issued on July 14, 2008 with respect to a workplace located at 602 Pine Mountain Court, Windsor, CO. Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a) ACC Roofing Inc., 1375 N. Harrison Street, Denver, CO 80206: On and before September 20, 2012, three employees were observed working on the side and back roofs of the fire department building without adequate fall protection measures in place. Employees were not wearing any fall protection and those employees who were wearing fall protection did not adjust the life lines appropriately to prevent free fall without touching the ground. These hazards point to a lack of training and exposed employees to fall hazards of 8 feet or more.

Citation text line 29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): a) ACC Roofing, Inc. at 1117 18th St, Greeley, CO 80631: On and before June 29, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Three subcontractor employees were working next to the edge of the roof on a one-story residential home without the use of a fall protection system. The subcontractor employees were removing flashing on the portion of the flat roof on the north side of the home. This condition exposed subcontractor employees to a fall hazard of approximately 20 feet to the ground below. b) ACC Roofing, Inc. at 1117 18th St, Greeley, CO 80631: On and before June 29, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees accessed the roof by using two extension ladders on the west side of the house. One extension ladder was used to access the 1st level of roof while the other was used to access the top flat portion of the roof. Both ladders were placed less than three feet above the landings. This condition exposed subcontractor employees to a fall hazard of approximately 10 feet to the ground below. ACC Roofing, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926. 20(b)(2) which was contained in OSHA Inspection Number 313410714, Citation 1, Item 1, issued on September 25, 2009, and became Final Order on November 13, 2009 with respect to a workplace located at 1801 Avery Plaza St., Severance, CO 80546.
