29 CFR 1926.1153(i)(2)(i)(B): Specific tasks in the workplace that could result in exposure to respirable crystalline silica; (a) Reconstruction Experts, Inc. at 2575 Des Moines Dr, Fort Collins, CO: On and around September 28, 2020, the controlling employer did not designate a competent person to make frequent and regular inspections of the job sites, materials, and equipment to ensure that subcontractors had developed and implemented Specified Exposure Control Methods or Alternate Exposure Control Methods and established a written exposure control plan, when subcontractor employees were exposed to airborne crystalline silica hazards by work tasks. Subcontractor employees cut Exterior Fiber-Cement, containing silica, with a hand saw but had not developed and implemented Specified Exposure Control Methods in that the hand saw did not have a dust collection system to comply with Table 1 Entry iii or Alternate Exposure Control Methods in that the subcontractors had not conducted exposure assessments to determine subcontractor employee exposure to silica. The subcontractors had not developed written exposure control plans for the tasks. This condition potentially exposed subcontractor employees to airborne crystalline silica hazards. 29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) (a) Reconstruction Experts, Inc. at 2163 Ulster Street, Denver, CO: On and around August 14, 2020, the controlling employer did not designate a competent person to make frequent and regular inspections of the job sites, materials, and equipment to ensure that subcontractors had developed and implemented Specified Exposure Control Methods or Alternate Exposure Control Methods and established a written exposure control plan, when subcontractor employees were exposed to airborne crystalline silica hazards by work tasks. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: (a) Reconstruction Experts, Inc. at 2550 Custer Drive, Unit C, Fort Collins, CO 80525: On and before January 27, 2015, the exposing/controlling employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that approximately twelve subcontractor employees and the controlling employer's superintendent were engaged in tearing off an old roof and applying a new roof on a single story apartment complex. This condition exposed the employees to a fall hazard of approximately 10 feet. Reconstruction Experts, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 742541, Citation Number 1, Item 1 issued on December 6, 2012 and became Final Order on December 20, 2012 with respect to a workplace located at 2450 Palmer Park Blvd., Colorado Springs, CO 80909. |

A Reconstruction Experts, Inc. employee and a Chivas Contractors employee were exposed to fall hazards of 11.5 feet while standing at the edge of the excavation where they were manually hoisting the spoils from the excavation up to the surface using a container tied to a rope. (b) On or about November 16, 2012, Reconstruction Experts, Inc., as the controlling contractor, did not protect workers of Riverstar Construction (subcontractor) from fall hazards while they were conducting roofing activities on a roof in excess of six feet above the lower surface. Reconstruction Experts, Inc. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) or its equivalent which was contained in OSHA inspection 315019174, Citation 1, Item 2a issued April 25, 2011, with respect to a workplace located at 4702-4762 & 4721-4761 Rowell Point, Colorado Springs, CO.
