The employer was installing new curbs and gutters at this location, and there was no signage on north and southbound High Street, and westbound 16th Avenue included only one sign placed several blocks away from the work activity area. This condition exposed employees working to the hazard of being struck-by vehicular traffic. |

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about June 15, 2016 and at times prior to that date, employees were exposed to struck-by hazards from vehicles while working on roadside operations as follows: 1) The responsible individual for the Temporary Traffic Control (TTC) plan did not ensure that the conditions of the TTC plan was carefully monitored and inspected. The TTC plan was not available on-site, TTC devices were not consistent used according to the TTC plan, and the TTC zone was not effective for motorists and workers. The responsible individual also did not halt the work until the applicable or remedial safety measures were used in place according to the TTC plan. Abatement Note: Feasible and acceptable methods to correct these hazardous conditions would be to follow the requirements in accordance to the instructions required in the Part VI of the Manual of Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2000. Sections 6B.01 discuss that the most important duty of the responsible individual is to ensure that the TTC plan be checked, monitored, and to be effective for the protection of the motorists, bicyclists, pedestrians, and workers. |

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition): a) On or about June 15, 2016 and at times prior to that date, employees were exposed to struck-by hazards from vehicles while working on roadside operations. Employees did not have the proper flagging equipment and were using their body and hands to warn and slow down the incoming vehicle traffic. Note: Part VI of the Manual of Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2000, 6B.01 provides that the control of road users through a temporary traffic control zone shall be an essential part of highway construction, utility work, maintenance operations, and incident management. Sections 6E.03 and 6E.07 discuss requirements associated with the hand-signaling devices such a s a Stop/Slow paddle should be the primary hand-signaling device, and the procedures that flaggers should follow to alert or slow the incoming traffic. |

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA: a) On or about June 15, 2016 and at times prior to that date, employees were exposed to struck-by hazards from vehicles while working on roadside operations as follows: 1) There were no warning signs near the location of the employees to warn the incoming vehicles. 2) Traffic control devices were not positioned on the road to protect the employees from incoming vehicle traffic while working on the road. One control device was positioned on the roadway while twelve other devices were positioned on the side walk area. Note: Part VI of the Manual of Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2000, Sections 6C.03 and 6C.04 discusses the requirements associated with advance warning areas, providing that the advanced warning area is that section of the highway where road users are informed about upcoming work zone or incident area. Sections 6F.63 and 6F.07 discusses that channelizing devices and barriers are used to warn road users of conditions created by work activities in or near the roadway and to guide road users while the temporary traffic barriers are used to channelize road users and also to protect the work space. Keene Concrete, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.200(g)(2), which was contained in OSHA inspection number 470501, citation 1, item number 2 and was affirmed as a final order on October 16, 2012, with respect to a workplace located at Mountain View Ave., to Hover St., Longmont, CO 80501. |

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees were exposed to being struck-by vehicular traffic and/or other road users. Keene Concrete, Inc., @ Mountain View Ave & Hover Street, Longmont, Colorado. On or before June 13, 2012, the exposing employer did not ensure that each employee performing road work activities within the Temporary Traffic Control (TTC) Work zone was wearing warning vest or other suitable garments marked with or made of reflectorized or high-visibility material. This condition exposed employees to the hazard of being struck-by moving vehicular traffic traveling at approximately 35-40 mph. (1) The hazard of being struck-by moving vehicles while working along the lane Work Zone without wearing high-visibility reflective vests. Among others, one feasible and acceptable abatement method to correct this hazard is to ensure that each employee who works in traffic work zones wears suitable vests such as those that meet the specifications for reflective materials r ANSI/ISEA 107-2004 STANDARD. Chapter 6D.- Pedestrian and Worker Safety as delineated in the Manual on Uniform Traffic Control Devices (MUTCD), 2003 Edition (Section 6D.03B Worker Safety Apparel) requires the use high visibility apparel such as those that meet ANSI/ISEA 107-2004 Standard for High Visibility. |

On or before June 13, 2012, the exposing employer did not ensure that the required traffic control signs or devices such as, but not limited to Road Work Ahead, Right Lane Closed, One Lane Road Ahead, Flagger Ahead, Merge Center Lane Ahead, were located so that approaching road users emerging from East Mountain View Ave were informed about the hazards they were approaching and had sufficient advanced warning before entering the upcoming work zone. This condition exposed on-site flaggers and construction workers to strike-by hazards from approaching vehicular traffic and/or other road users.
