Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Castillo Excavating, Inc., 152 Baylor Drive, Longmont, CO 80501: On or about September 7, 2021, while in the process of replacing a sewer-line in an unprotected trench that measured 7- 8 feet in depth, a section of the trench collapsed trapping an employee. The employer failed to ensure that the excavated area was inspected by a competent person prior to the start of work activities, and as needed throughout the shift for evidence of conditions issues (e.g.: soil sloughing; Fissures or cracks, etc.) that would affect the integrity of the trench.

Citation text line 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On or about September 07, 2021, at a jobsite located at 152 Baylor Drive in Longmont, CO, the employer did not ensure that cave-in protection was used by employees in the process of replacing a sewer-line. An employee (the owner) entered into an unprotected trench which measured (approx.) 7 - 8 feet in height, 2 - 3 feet in width and (approx.) 14 feet long. The trench was not inspected for condition issues prior to the start of work activities, and a ladder egress not being used. The trench collapsed trapping the employee. Two additional employees enter the unprotect excavation in an attempt to assist the trapped employee. All of the employees were exposed to caught in hazard.
