29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Tech-Western, Inc. @ 14462 Garfield Street, Brighton, Colorado 80233: On and before May 19, 2016, as part of the injury/accident prevention responsibilities, the excavating and exposing employer did not ensure that the spoil pile was set back at least two feet to prevent rocks and soil from falling into the trench. The excavation was approximately 55 inches deep. The spoil pile included large round rocks that were not adequately contained. These conditions exposed employees to struck-by hazards. |

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Tech-Western, Inc. @ 14462 Garfield Street, Brighton, Colorado 80233. On and before May 19, 2016, as part of the injury/accident prevention responsibilities, the excavating and exposing employer did not ensure that a competent person conducted inspections of this excavation for hazardous conditions. The excavation was approximately 55 inches deep. The excavation included groundwater, creating an unstable base for the walls. No sloping, benching, or shield system was in place. The spoil pile included large round rocks that were not adequately contained. These conditions exposed employees to cave-in hazards and struck-by hazards. Abatement note: The requirements and duties of a competent person are: (1) A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them. (2) The competent person must understand and be able to carry out the tasks specified in the OSHA standard. The competent person must also have knowledge about excavation protection systems or plans and the safety program. |
