Citation text line Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazard of infrared radiation exposure from a Class IV Carbon Dioxide laser: (a) Jobsite Inc at 1454 Highway 50, Delta, CO 80416: On and before April 20, 2011, the employer did not ensure employees were fully protected from exposure to hazards associated with the operation of a Mitsubishi Class IV Carbon Dioxide. Employees cut on steel, stainless steel, and aluminum to manufacture customer-specific job-shop parts. This condition exposes employees to eye and skin hazards associated with the use of a Class IV Carbon Dioxide laser. Abatement Note: Among other methods, one feasible abatement method would be to install all safety cabinet panels and interlocks which would reduce the laser hazars to that of a Class 1 laser. A second feasible abatement method would be to institute a Laser Safety Program as described in the American National Standard for Safe Use of Lasers, ANSI Z136.1-2000, or newer. Such a safety program would include: (1) Delegation of authority and responsibility to the Laser Safety Officer for the monitoring and enforcement of hazard evaluation and control of laser hazards; (2) Education of authorized personnel (Laser Safety Officers, operators, service personnel and others) in the safe use of lasers and laser systems, and as applicable, the assessment and control of laser hazards; (3) Application of adequate protective measures for the control of laser hazards as required in Section 4 of the ANSI standard; (4) Incident investigation, including reporting of alleged accidents, and preparation of action plans for the future prevention of accidents following a known or suspected incident; and, (5) Provide an appropriate medical surveillance program in accordance with Section 6. This condition exposes employees to respiratory hazards associated with the use of negative pressure respirators. Abatement Note: The employer shall include in the program the following provisions of this section, as applicable: (1) Procedures for selecting respirators for use in the workplace; (2) Medical evaluations of employees required to use respirators; (3) Fit testing procedures for tight-fitting respirators; (4) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; (5) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; (6) Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; (7) Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; (8) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and, (9) Procedures for regularly evaluating the effectiveness of the program. In addition, waste material was collected in open plastic buckets and was not disposed of daily.
