29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent: a) On or about March 22, 2012 and at times prior, the employer did not protect the hearing of employees by developing and implementing a hearing conservation program which included initial noise monitoring, baseline and annual audiograms, and employee training for employees that worked with grinding, sanding, sawing and mold making equipment and were exposed to an 8-hour time-weighted average (TWA) sound level of greater than 85dBA (50% dose). On June 19, 2012, an employee operating some of this equipment was exposed to an average noise level of 89.3 dBA which equated to an 82% dose as an 8-hour TWA. The sampling was conducted for a period of 432 minutes, and the dose calculation assumed zero exposure for the unsampled portion of the shift. |
